One of the immigration cases our firm recently represented involved a client who had originally entered the United States on a B-2 visitor visa and attempted to seek asylum. After receiving a denial from an immigration judge on his application to seek affirmative asylum, the man was granted voluntary departure. Shortly before his designated departure date, he married his U.S. citizen girlfriend, and our firm was able to represent both parties in the Form I-130, Alien Relative Petition that the wife filed on her husband’s behalf.
After obtaining approval on the I-130 petition, we then proceeded to petition the government and get their agreement to join us in the motion to reopen our client’s case based on the fact that he was now eligible to adjust his alien status to permanent resident. As a result of our joint filing with the government, our client was not subjected to the time limit for filing, which was extremely fortunate as that time limit had already passed prior to us being retained as legal counsel.
The immigration judge granted our motion to reopen and we are proud to state that our client will now be able to pursue an adjustment of status either in the immigration court or with the United States Citizenship and Immigration Services (USCIS) after his removal proceedings have been formally terminated.
