ما الفرق بين تأشيرات المهاجرين وتأشيرات غير المهاجرين؟

هناك أنواع متعددة من التأشيرات المتاحة بموجب أحكام قانون الهجرة والجنسية بالولايات المتحدة، ولكن يمكن تقسيمها إلى فئتين رئيسيتين: تأشيرات المهاجرين وتأشيرات غير المهاجرين. يُخصص النوع الأول للأفراد الراغبين في الحصول على حق الإقامة الدائمة بالولايات المتحدة من خلال البطاقة الخضراء، وربما الحصول على الجنسية الأمريكية في نهاية المطاف. أما النوع الثاني، فهو مخصص للراغبين في زيارة الولايات المتحدة بصورة مؤقتة، ولأسباب تتعلق بممارسة أعمال تجارية أو الالتحاق بمدرسة أو جامعة.

كم يبلغ عدد المهاجرين المقبولين بالولايات المتحدة سنويًا؟

يضع قانون الهجرة والجنسية حدًا لعدد المقبولين للهجرة بالولايات المتحدة سنويًا باستخدام أنواع معينة من التأشيرات، بينما هناك بعض التأشيرات التي تتوفر بعدد لا محدود سنويًا. فمثلًا، يتوفر عدد لا محدود من تأشيرات الهجرة العائلية للأقارب المباشرين للمواطنين الأمريكيين، بينما هناك حصص محدودة من التأشيرات المخصصة لأقارب المقيمين الدائمين، وأفراد العائلة الممتدة للمواطنين الأمريكيين، وتبلغ 480 ألف تأشيرة سنويًا. كذلك يبلغ عدد التأشيرات المتاحة لأغراض العمل 140 ألف تأشيرة سنويًا.

ما هي شروط الأهلية للجنسية الأمريكية؟

تشمل مسارات الحصول على الجنسية الأمريكية الخدمة في الجيش الأمريكي والتبني، ولكن نسبة كبيرة من المقيمين يحصلون عليها من خلال عملية التجنيس. وتشمل المؤهلات الأساسية للحصول على الجنسية الأمريكية ما يلي:

العيش في الولايات المتحدة كمقيم دائم لمدة 5 سنوات (أو 3 سنوات لزوج/زوجة المواطن الأمريكي)
ألا يقل عمر المتقدم عن 18 عامًا
الإقامة في الولاية التي يتم التقديم منها لمدة 3 أشهر على الأقل قبل تاريخ التقديم
التواجد الفعلي داخل الولايات المتحدة لنصف المدة (التي تبلغ 5 سنوات) على الأقل
التواجد المستمر في الولايات المتحدة من تاريخ تقديم طلب التجنيس
القدرة على القراءة والكتابة والتحدث باللغة الإنجليزية
امتلاك درجة من الفهم الأساسي للحكومة الأمريكية ومبادئها الوطنية

ما هو القرار المؤجل؟

في يونيو 2012، وجهت إدارة أوباما وزارة الأمن الوطني إلى البدء في تطبيق سياسة تُسمى “القرار المؤجل للواصلين أطفالًا” (DACA). وبموجب هذه السياسة، تمارس الوزارة صلاحيتها التقديرية في تطبيق القوانين المتعلقة بترحيل وإبعاد المهاجرين المتواجدين داخل الولايات المتحدة بصورة غير شرعية. إن سياسة القرار المؤجل لا تغير القوانين الحالية، ولكنها تغير طريقة تطبيقها. قد تكون مؤهلًا للحصول على إعفاء من الترحيل تحت مظلة هذه السياسة إذا كان عمرك أقل من 31 عامًا في يوم 15 يونيو 202، وكنت قد دخلت الولايات المتحدة قبل بلوغ السادسة عشر، وكنت مقيمًا بالولايات المتحدة بصفة مستمرة منذ 15 يونيو 2007، وكنت ملتحقًا بالجامعة أو المدرسة، أو تخرجت من المرحلة الثانوية، أو حصلت على شهادة تطوير التعليم العام (GED)، إلى جانب بعض المعايير الأخرى. ومن خلال القرار المؤجل، يتجنب المقيم خطر الترحيل، مع العلم أن القرار لا يعني تغيير حالة الهجرة الخاصة به.

كيف أتجنب الترحيل؟

I couldn’t have picked a better team. The team at Fayad law handled my case from the beginning to the end. From EB-2 National Interest Waiver (NIW) petition documents, to work authorization documents to adjustment of status. Everything was done responsibly and in a timely manner. My Immigration journey may be over, but I will always refer any friends, family or colleagues to Fayad law. I was a PhD student, and I was dreaming to work in pharma companies after my graduation without being stuck at academia like thousands of immigrant’s students and post-docs. Fayad law made the impossible things very possible and smooth. I was a rare case as a PhD student who immediately graduated, got a job at a big biotech and started my job smoothly. My journey with Fayad Law started almost a year ago and we had one of the most stressful but successful journeys in my life together.I am a STEM scientist, and I was thinking about doing a self-petition for NIW, but the backlog forced me to try my chance for EB-1A because I didn’t have much time on my visa, and it was the only current option in the Visa Bulletin for me.I talked with many attorneys, and no one gave a chance to my case for EB1-A, and they pushed me to NIW (not to mention some of them didn’t even believe I would make it to NIW). Aida was the only one who listened and said we had a slight chance. No need to say we took that slight chance to the approval. Now looking back and realize things moved exactly like she described me during our first meeting which is an indicator of her experience in this field. Long story short, I was holding my green card a year after I signed the contract with Fayad to represent me.I would recommend Fayad because Aida was one of the most informative attorneys I had consulted during my research (it took me over a year to decide on an attorney) and I think she put my case together well to represent me to USCIS. I am most likely to continue the next steps with them as well.However, everyone going into a green card journey needs to take into consideration that this journey is not easy or short and every case is unique. There will be many ups and downs and most importantly you need to be on top of your case sometimes even more than your attorney does.I wish good luck to everyone!

I had a free half hour consultation with Ms. Ingy Giurguis (who speaks both English and Arabic). In just 20 minutes, I had already changed my perspective about my file. It was an eye opening experience. I am seriously thinking of transferring my file to their office. Ms. Giurguis is knowledgeable, well experienced, and good hearted. She was honest with me. The whole thing was like a paradigm shift. This is not an easy thing to achieve, especially given my hard-to-persuade character! I am giving just 4 stars because I haven’t yet dealt with the office in depth. As soon as I do transfer my file, see how they really handle it, the thing I am sure they would do properly, I am going to Five Star Rating!
